Attorney General's Opinion concerning Annexation of Open Space - "We respectfully disagree. In our opinion, the land use restrictions created by the open space easements remain enforceable following annexation."

Ransom: "What was the town council's thought process in this?"

Request for Attorney General's opinion - "... does the county have the power to enact an ordinance that provides for the continuation of' that open space requirement even after the subject land is annexed into a municipality with zoning authority ...?  The Town Council of the Town of Centreville contends that the answer to this question is that upon annexation easements granted to the county to enforce county subdivision and zoning regulations become null and void because the regulations they enforce are null and void."

Dec 18, 2003 Letter from Hodgson to QAC Commissioners - "Claiborne Properties. Inc. requests the cooperation of Queen Anne's County in releasing the open space easements and also granting a waiver to the Town of Sudlersville to authorize the town to zone the subject property for residential development as recommended by the Town of Sudlersville Comprehensive Plan."

Dec 18, 2003 Letter from Whitehill(McCrone) to Cal Gray - "If the County extinguishes the open space covenants on the remaining lot 13 and expressly agrees to an annexation agreement to grant the waiver of the 5-year zoning consistence. .... A separate document abandoning County easements/covenants should be prepared because the Town should want no part of that issue."
